GENERAL TERMS AND CONDITIONS OF SALE
Article 1 – SCOPE
The purpose of these general terms and conditions is to set the terms and conditions under which Jaguar Land Rover France, a French simplified joint-stock company with share capital of €3,115,880, registered with the Nanterre Trade and Companies Register under the number 509 016 804, whose registered office is at Tour Défense Plaza, 23 rue Delarivière Lefoullon, 92800 Puteaux, Tel.: +33(0)1 70 65 30 09, Email: concierge@rangeroverhouse.info (hereinafter "Jaguar Land Rover France"), offers services, goods or events (hereinafter "Events and Experiences") to people wishing to visit the Range Rover House Côte d'Azur, invited by Jaguar Land Rover France or directly registered via the Website of the Range Rover House Côte d’Azur, hereinafter "the Guests".
Article 2 – RESERVATION OF EVENTS AND EXPERIENCES
The Events and Experiences offered as part of the Range Rover House Côte d’Azur, and described on the Website, have been negotiated by Jaguar Land Rover France with selected service providers and/or suppliers for the Guests (hereinafter, the "Service Providers").
Guests can book their experience on the Website of Range Rover House Côte d’Azur https://houses.infojaguarlandrover.com/cote-d-azur (hereinafter, the “Website”).
As the number of seats per experience is limited, reservations are available according to the number of seats defined by Jaguar Land Rover France. If the number is exceeded, a waiting list is available to be informed as soon as a place becomes available.
Events and Experiences may be offered to Guests free of charge or by payment of a financial contribution.
2.1 Free Events and Experiences
Prior reservation is mandatory for free Events or Experiences.
The fact that an Event or Experience is free of charge will be indicated on the Website. No financial contribution will be required from Guests when making a reservation for a free Event or Experience.
2.2. Paid Events and Experiences
For paid Events or Experiences, the financial contribution required from Guests is payable when booking the Event or Experience on the Website.
The reservation is considered to be validated on the date of the effective payment via the secure payment module available on the Website (Status: Registered).
Guests then receive a confirmation email. All receipts issued as part of a Range Rover House Côte d’Azur Event or Experience will be kept by OPPIDUM COMMUNICATION SAS using the STRIPE module for 12 months following their issue, before being deleted.
Article 3 – PAYMENT TERMS
Payment for participation shall be made on-line by credit card only. The credit cards accepted are CB, Visa, Eurocard/Mastercard. The transaction is immediately debited from the Guest's bank card after verification of the Guest's data, upon receipt of the debit authorisation from the company issuing the bank card used by the Guest.
The agreement to pay using a payment card is irrevocable. By communicating the information relating to their credit card, the Guest authorises Jaguar Land Rover France, or any service provider acting on its behalf, to debit their credit card in the amount equal to the price including tax.
To this end, by filling in the requested information, the Guest confirms that they are the holder of the credit card to be debited and that the name appearing on the credit card is indeed their own.
In the event that the debit of the contribution is impossible, the sale is immediately automatically terminated and the reservation is cancelled.
Online payments are made using the STRIPE module, in the context of which Jaguar Land Rover France has mandated OPPIDUM COMMUNICATION SAS to collect on its behalf the sums due to it in respect of reservations for Events and Experiences and to issue the corresponding receipts.
JAGUAR LAND ROVER France remains solely liable to the Guest for the smooth running of the service sold and any decision concerning the organisation of the Event or Experience. JAGUAR LAND ROVER France will, if necessary, mediate between the Guest holding the card and OPPIDUM COMMUNICATION SAS in the event of a litigation concerning the proper performance of the payment service.
Article 4 – RIGHT OF WITHDRAWAL AND CANCELLATION
4.1 Right of withdrawal
In accordance with article L 221-28 of the French Consumer Code, the right of withdrawal may not be exercised for provision of accommodation services, other than residential accommodation, transport services for goods, car rental services, catering or leisure activities that must be provided on a specific date or period.
4.2 Cancellation
4.2.1 By Jaguar Land Rover France
In the event that the Event or Experience is cancelled by Jaguar Land Rover France, Jaguar Land Rover France will reimburse the Guest for the full amount paid for the reservation of the Event or Experience no later than fourteen days after the cancellation.
4 .2.2 By the Guest
Any cancellation of a reservation for a paid Event or Experience at the initiative of the Guest will result in the refund of the sums paid to Jaguar Land Rover France under the following conditions:
§ Refund up to 100% of the sums paid if the cancellation occurs no later than 7 days before the date of the event,
§ No refund if the cancellation occurs less than 7 days before the date of the event.
In the event of cancellation for Force Majeure, the Guest shall provide documents in support of the existence of a Force Majeure event.
Cancellation must be sent by the Guest to Jaguar Land Rover France via the Website under the section "My Bookings", accessible from the confirmation email.
The cancellation date taken into account will be the date of receipt of the cancellation request by Jaguar Land Rover France.
Jaguar Land Rover France will make the refund, via its service provider STRIPE, within 10 days, to the Guest’s bank account used for payment.
Article 5 – COMPLAINTS

Article 6 - CONFIDENTIALITY AND PROTECTION OF PERSONAL DATA
Jaguar Land Rover France uses all means to ensure the confidentiality and security of the personal data transmitted when booking an Event or an Experience.
Personal information collected by Jaguar Land Rover France from Guests will be processed automatically.
The main purpose of the processing in question is the provision of the service reserved for the Guest, including in particular the administrative management of the payment by the Guest.
The legal basis for this processing is the performance of the contract concluded between the Guest and Jaguar Land Rover France under the booked Event or Experience, governed by these general terms and conditions. As such, when certain information is mandatory to access certain Events or Experiences, Jaguar Land Rover France will indicate such mandatory nature at the time of data entry.
Jaguar Land Rover France works with third party service providers in the management of the Range Rover House. In particular, Oppidum Communication, a limited liability company with share capital of €10,000, registered with the Clermont-Ferrand Trade and Companies Register under number B 502 181 969, having its registered office at Centre Saint-Paul 4, Bd de la Sous-Préfecture 63500 ISSOIRE, manages many operational aspects of the RANGE ROVER HOUSE CÔTE D’AZUR programme on behalf of Jaguar Land Rover France, and processes the personal data of the Guests in its capacity as processor. Other processors may be recipients and process the personal data of the Guests on behalf of Jaguar Land Rover France, in particular in the context of IT maintenance services, hosting and management of the Website.
The information collected from Guests may also be communicated to the Service Providers who provide the booked Event or Experience, if this is necessary for the performance of the service. It is the responsibility of the Guest to contact said service providers in order to consult their personal data management policies.
In accordance with Regulation (EU) 2016/679 of 27 April 2016 (called “General Data Protection Regulation”) and the French law 78-17 of 6 January 1978 (called “Data Protection Act”) as amended, the Guest has in particular the following rights over their personal data: right of access, right of rectification, right to erasure (“right to be forgotten”), right to object, right to restrict processing, right to portability. Guests may also set guidelines relating to the retention, deletion and disclosure of their personal data after their death.

A copy of an identity document may be requested to verify the identity of the applicant.
The Guest also has the right to lodge a complaint with the French Data Protection Authority (CNIL), whose website can be consulted at the following address: www.cnil.fr
Jaguar Land Rover France uses information systems that are hosted in the EU. However, it may share Guests' personal data with suppliers or Jaguar Land Rover group companies located outside the EU when necessary for the purposes described above. Jaguar Land Rover puts in place measures to ensure that the transfers thus carried out meet the requirements of European and French data protection regulations. This may include, in particular, an assessment of the level of data protection in the third country in question and whether or not there is an adequacy decision by the European Commission in this regard (including, for entities located in the United States, its decision on the EU-U.S. Data Privacy Framework), as well as the establishment of appropriate safeguards such as standard contractual clauses approved by the European Commission, if necessary combined with additional measures to protect the data concerned.

Jaguar Land Rover will retain the Guests’ personal data for the period strictly necessary for the management of their reservation, to comply with its legal obligations, answer questions, resolve disputes and enforce its rights, taking into account its legitimate interests. The criteria used to determine the retention periods are: the different purposes of the processing concerned, the category of data processed, the retention period strictly necessary to ensure their performance as well as the recommendations in this regard of the French Data Protection Authority (CNIL), the applicable contractual provisions in force, the statutory limitation periods, the applicable regulatory requirements and industry standards.
In accordance with Articles L223-1 and L223-2 of the French Consumer Code, Customers are informed that they have a right to register on a list of opposition to telephone canvassing accessible at the following address: http://www.bloctel.gouv.fr/
Article 7 – GOVERNING LAW
These general terms and conditions shall be governed by French law and subject to the jurisdiction of the French courts.
In accordance with Article L 612-1 of the French Consumer Code, the Guest is informed of the possibility of resorting, in the event of a dispute, to a conventional mediation procedure or to any other alternative means of dispute resolution. In the event of persistent disagreement, the Guest may send a written complaint to the consumer mediator referenced by Jaguar Land Rover France: the CMFM, which may be notified, in writing, online on the website www.mediationcmfm.fr or by post to the following address: Mediation CMFM, 19 avenue d'Italie, 75013 Paris.
In the absence of an amicable resolution, the dispute will be referred to the competent court.
In the event of a dispute between professionals, the competent court will be the Commercial Court of Nanterre.
